ROYAL CLUB KOSHER

These Terms & Conditions govern the use of the Royal Club Kosher website and the booking of hospitality and vacation programs arranged by R.C.K. Luxury Tourism, trading as Royal Club Kosher (the “Company” or “Royal Club Kosher”).

By using this website, submitting a booking request or completing a booking, you acknowledge that you have read and agreed to these Terms & Conditions.

1. BOOKINGS

Information, prices and availability displayed on the website are for informational purposes only and do not constitute a binding reservation.

A booking becomes binding only upon written confirmation by Royal Club Kosher and payment in accordance with the payment terms stated in the applicable booking confirmation, proposal or invoice (the “Booking Confirmation”).

The person making the booking is responsible for providing complete and accurate information regarding all guests included in the booking and represents that he or she is authorized to make the booking on their behalf.

The Booking Confirmation will set out the principal commercial terms applicable to the booking, including the accommodation, dates, price, payment schedule and any specific cancellation terms.

2. THE PROGRAM

The services included in each program are only those expressly specified in the relevant Booking Confirmation and/or program description.

Flights and airline services are not included unless expressly stated otherwise in writing.

Photographs, menus, schedules, entertainment, speakers, activities and other program information published on the website or in promotional materials reflect the program as planned at the time of publication and may be subject to reasonable changes.

Royal Club Kosher may make reasonable changes to the program, schedule, activities, entertainment, menus or service providers where required for operational, safety, religious, regulatory or other reasonable considerations, provided that the overall nature and standard of the program are not materially reduced.

3. ACCOMMODATION

Room categories are subject to availability and will be as specified in the Booking Confirmation.

Requests regarding a particular floor, view, location, proximity to other rooms, bed configuration or similar preferences will be taken into consideration but cannot be guaranteed unless expressly confirmed in writing.

Hotel facilities, services, check-in and check-out arrangements and other matters relating to the stay are subject to the hotel's own rules, policies and operating arrangements.

4. PRICES AND PAYMENT

The applicable price and payment schedule are those stated in the Booking Confirmation.

Failure to make any payment when due may, following reasonable notice, result in cancellation of the booking and application of the applicable cancellation terms.

Any bank, credit-card or currency-conversion charges imposed by third parties shall be the responsibility of the customer unless otherwise stated.

5. CANCELLATIONS BY THE CUSTOMER

Cancellation requests must be submitted to Royal Club Kosher in writing.

Cancellation rights, cancellation charges and refunds shall be governed by the cancellation terms stated in the Booking Confirmation and by any mandatory rights available to the customer under applicable law.

Where applicable law grants the customer a statutory right of cancellation, nothing in these Terms & Conditions or in the Booking Confirmation shall derogate from such right.

Where permitted by applicable law in relation to tourism services provided entirely outside Israel, the customer may be offered a cancellation arrangement based on the cancellation policy of the overseas service provider. Any such arrangement shall apply only where it has been properly disclosed and agreed in accordance with applicable law.

No refund shall be due for services voluntarily not used after commencement of the stay, except where required by applicable law.

Guests are strongly advised to purchase appropriate travel and cancellation insurance immediately upon booking.

6. CHANGES TO THE PROGRAM

Royal Club Kosher may make reasonable changes to the program or any element thereof where necessary due to operational requirements, circumstances beyond its reasonable control, safety considerations, religious requirements, regulatory requirements or changes made by the hotel or other service providers.

Where reasonably practicable, Royal Club Kosher will endeavor to provide a service or arrangement of a generally comparable nature and standard.

Changes to schedules, activities, entertainment, speakers, menus, suppliers or other non-essential elements of the program shall not constitute a material change to the booking, provided that the overall nature and standard of the program are not materially reduced.

7. CANCELLATION DUE TO EXTRAORDINARY CIRCUMSTANCES

Royal Club Kosher may cancel, postpone, relocate or materially modify a program where, due to circumstances beyond its reasonable control, Royal Club Kosher reasonably determines that the program cannot be operated safely, lawfully, commercially, economically or operationally as planned.

Such circumstances may include, without limitation, war or threat of war, terrorism, hostilities, civil unrest, epidemic or pandemic, public health concerns, natural disaster, extreme weather, governmental action or restrictions, travel restrictions or advisories, closure of borders or airports, significant disruption of international air travel, strikes, interruption or unavailability of essential services or supplies, material changes affecting the hotel or essential service providers, or any other extraordinary circumstances beyond the reasonable control of Royal Club Kosher that materially affect the safety, feasibility, viability or economic basis of the program.

Royal Club Kosher may exercise this right where the relevant circumstances, individually or in combination, make the operation of the program impossible, unsafe, unlawful or commercially or economically unreasonable, even where performance has not become strictly impossible.

A cancellation, postponement, relocation or modification made in good faith pursuant to this section shall not constitute a breach of contract by Royal Club Kosher.

In such circumstances, Royal Club Kosher may, subject to applicable law, offer guests an alternative program, postponement or credit toward a future program.

If Royal Club Kosher cancels the program and no alternative arrangement is offered or accepted, the Company's obligations in respect of amounts paid by guests shall be determined in accordance with the applicable Booking Confirmation and applicable law.

To the fullest extent permitted by applicable law, Royal Club Kosher shall not be liable for any additional compensation, consequential or indirect loss, airfare, alternative travel arrangements or other expenses incurred by guests as a result of such cancellation, postponement, relocation or modification.

Nothing in this section shall exclude or limit any right that cannot lawfully be excluded or limited.

8. FLIGHTS, PASSPORTS AND ENTRY REQUIREMENTS

Unless expressly included in the Booking Confirmation, guests are solely responsible for arranging their flights to and from the destination.

Royal Club Kosher is not responsible for airline cancellations, delays, schedule changes, missed connections, baggage loss or any other act or omission of an airline or transportation provider not contracted by Royal Club Kosher as part of the package.

Each guest is responsible for ensuring that he or she holds a valid passport and any visa, entry permit, transit authorization, health documentation or other document required for the destination and travel route.

Guests are responsible for checking current entry, exit and transit requirements applicable to their nationality and individual circumstances.

Any information or assistance provided by Royal Club Kosher concerning flights, passports, visas or entry requirements is provided for convenience only and does not relieve the guest of this responsibility.

9. KOSHER PROGRAM

The applicable kosher supervision and principal kashrut standards will be stated in the relevant program materials.

Guests are required to comply with the kashrut, Shabbat and holiday arrangements established for the program and with reasonable instructions issued by Royal Club Kosher or the applicable kosher supervision.

Royal Club Kosher may make reasonable operational adjustments where required by the supervising authority or for religious requirements.

10. HEALTH, SPECIAL REQUIREMENTS AND INSURANCE

Guests should inform Royal Club Kosher before completing a booking of any material accessibility, dietary or other special requirement relevant to the provision of the services.

Royal Club Kosher will make reasonable efforts to communicate such requests to the relevant hotel or service provider but cannot guarantee that any particular requirement can be accommodated unless expressly confirmed in writing.

Each guest is responsible for determining whether he or she is medically fit to travel and participate in the relevant activities.

Guests are strongly advised to obtain comprehensive travel insurance covering, as appropriate, medical expenses, cancellation, interruption, baggage and other travel-related risks.

11. ROLE OF ROYAL CLUB KOSHER; THIRD-PARTY SERVICES

Royal Club Kosher acts solely as an organizer and intermediary in arranging the booking of accommodation and other services provided to guests by the hotel and various independent third-party service providers.

The accommodation, hotel facilities, food and beverages, transportation, activities, excursions, entertainment and any other services or facilities made available to guests are provided by the hotel or the relevant independent service provider, as applicable, and not by Royal Club Kosher.

Each hotel or service provider is directly and exclusively responsible to the guest for the services and facilities provided by it, including their quality, availability, operation, safety and compliance with applicable standards. The hotel and the relevant food and beverage providers are likewise responsible for the preparation, quality and service of food and beverages provided to guests.

Royal Club Kosher does not own, operate or control the hotel or the independent service providers and, to the fullest extent permitted by applicable law, shall not be responsible or liable for any act, omission, negligence, default or failure of the hotel or any such service provider, or for the quality or performance of any service or facility provided by them.

Accordingly, to the fullest extent permitted by applicable law, Royal Club Kosher shall not be liable for any injury, illness, death, loss, theft, damage to property, loss of baggage or personal belongings, accident, inconvenience, interruption, deficiency in service or any other loss or damage arising during or in connection with the guest's stay or use of any service or facility provided by the hotel or any independent service provider.

Royal Club Kosher's responsibility is limited to arranging and processing the guest's booking in accordance with the Booking Confirmation and on the basis of the information and details provided by the person making the booking.

Royal Club Kosher shall not be responsible for any error, omission, additional cost or inability to provide a service resulting from inaccurate, incomplete or outdated information supplied by the customer.

Nothing in these Terms & Conditions shall exclude or limit any liability of Royal Club Kosher that cannot lawfully be excluded or limited under applicable law.

12. GUEST RESPONSIBILITY AND DIRECT RELATIONSHIP WITH THE HOTEL

Guests are required to comply with the rules, policies, procedures and reasonable instructions of the hotel and of any applicable service provider throughout their stay.

Each guest shall be directly and solely responsible to the hotel and/or the relevant service provider for any charges, expenses, purchases or services incurred or requested by the guest that are not expressly included in the Booking Confirmation. This includes, without limitation, room service, minibar charges, spa treatments, laundry, telephone charges, additional food or beverages, upgrades, activities, rentals, purchases and any other personal or incidental expenses.

Guests shall also be directly and solely responsible for any loss of or damage to hotel property, rooms, furnishings, equipment or other property caused by the guest, members of the guest's party or persons for whom the guest is responsible.

The hotel may require guests, at check-in or at any other time in accordance with its policies, to provide a credit card authorization, cash deposit or other security to secure payment of incidental charges, additional services, purchases, damage or other amounts for which the guest may become liable to the hotel. Any such deposit or security arrangement is solely between the guest and the hotel.

All matters relating to a guest's conduct at the hotel, use of hotel facilities, personal expenses, incidental charges, deposits, purchases, additional services, damage to hotel property and compliance with hotel rules shall be handled directly between the guest and the hotel. Royal Club Kosher shall not be a party to, or responsible for, any such obligation, charge, deposit, claim or dispute.

The guest shall be responsible for settling all amounts due directly to the hotel or any other service provider before departure, and Royal Club Kosher shall have no obligation to pay, advance, guarantee, reimburse or otherwise assume responsibility for any such amounts on behalf of the guest.

If Royal Club Kosher is required to pay any amount to the hotel or another service provider as a result of a guest's acts, omissions, purchases, charges or damage, the guest shall reimburse Royal Club Kosher for such amount, subject to applicable law.

13. GUEST CONDUCT

Guests are expected to behave respectfully and to comply with applicable law, hotel rules, safety requirements and reasonable instructions of the hotel, service providers and Royal Club Kosher staff.

Royal Club Kosher may, where reasonably necessary, terminate the participation of a guest whose conduct is unlawful, dangerous, abusive, seriously disruptive or materially interferes with the safety, rights or enjoyment of other guests, hotel personnel, service providers or Royal Club Kosher staff.

Any refund in such circumstances shall be subject to the applicable Booking Confirmation and applicable law.

14. LIMITATION OF LIABILITY

Without derogating from the provisions concerning third-party services above, Royal Club Kosher shall be responsible only for obligations expressly undertaken by it under the Booking Confirmation and these Terms & Conditions.

To the fullest extent permitted by applicable law, Royal Club Kosher shall not be liable for indirect, incidental, special or consequential loss or damage; loss arising from circumstances beyond its reasonable control; or loss resulting from the acts or omissions of the guest, the hotel or any independent third-party service provider.

Royal Club Kosher shall not be responsible for loss or damage to money, valuables, baggage or personal belongings during the program.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

15. WEBSITE AND INTELLECTUAL PROPERTY

All content on this website, including the Royal Club Kosher name and logo, text, photographs, graphics, designs, videos and other materials, is owned by or licensed to Royal Club Kosher.

No content may be copied, reproduced, distributed, published, commercially exploited or otherwise used without prior written permission, except for personal and non-commercial use.

Royal Club Kosher does not guarantee that the website will at all times be uninterrupted, error-free or free from technical difficulties.

16. PRIVACY

Personal information submitted through the website or in connection with a booking will be processed in accordance with Royal Club Kosher's Privacy Policy and applicable law.

Information may be provided to the hotel, payment processors and other relevant service providers where reasonably necessary to process the booking and provide the requested services.

17. GOVERNING LAW

These Terms & Conditions and bookings made with Royal Club Kosher shall be governed by the laws of the State of Israel.

The competent courts in Israel shall have jurisdiction over disputes arising in connection with these Terms & Conditions or a booking, subject to any mandatory consumer protection or jurisdictional rights that cannot lawfully be excluded.

18. GENERAL

The Booking Confirmation, these Terms & Conditions and the applicable Privacy Policy together constitute the terms governing the booking.

In the event of a conflict between these Terms & Conditions and specific commercial terms contained in the Booking Confirmation, the Booking Confirmation shall prevail with respect to those specific commercial terms, subject to applicable mandatory law.

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by Royal Club Kosher to enforce any provision on a particular occasion shall not constitute a waiver of that provision or of its right to enforce it on any other occasion.
